All pricing is in U.S. Dollars (USD) and is subject to change without notice. All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an order confirmation email containing your order details and a formal invoice. Title and risk of loss for all products you order pass to you upon our delivery of the products to the carrier. You are responsible for filing any claims with carriers for damaged and/or lost shipments.

7. Disclaimer of Warranties and Limitation of Liability

a. Disclaimer of Warranties: YOU EXPRESSLY AGREE THAT YOUR USE OF THE SITE AND THE PRODUCTS PROCURED VIA THE SITE IS AT YOUR SOLE RISK. Limitation of Liability: TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MYTA WOOD LLC, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, INTERNS, SUPPLIERS, SERVICE PROVIDERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, PERSONAL INJURY, OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, ARISING OUT OF OR IN ANY WAY RELATED TO THE USE OF, OR THE INABILITY TO USE, THE SITE OR THE PRODUCTS, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO CASE SHALL THE AGGREGATE LIABILITY OF MYTA WOOD LLC ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE EXCEED THE AMOUNT ACTUALLY PAID BY YOU TO MYTA WOOD LLC FOR PRODUCTS IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100.00) IF YOU HAVE NOT MADE ANY PAYMENTS TO MYTA WOOD LLC.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

8. Indemnification

You agree to defend, indemnify, and hold harmless MYTA Wood LLC, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Site, including, but not limited to, your User Contributions, any use of the Site’s content, services, and products other than as expressly authorized in these Terms or your use of any information obtained from the Site.

9. Governing Law and Dispute Resolution

a. Governing Law: These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.

b. Informal Dispute Resolution: We strongly believe in resolving disputes amicably. Before initiating a formal proceeding, you agree to try to resolve the dispute informally by contacting us at mytawoodllc@gmail.com. Similarly, if we have a dispute with you, we will contact you at the email address associated with your account.

c. Binding Arbitration: If a dispute cannot be resolved informally, you and MYTA Wood LLC agree to resolve any claims relating to these Terms or the Site through final and binding arbitration in Travis County, Texas, except as set forth below. The American Arbitration Association (AAA) will administer the arbitration under its Commercial Arbitration Rules. The arbitrator’s award shall be binding and may be entered as a judgment in any court of competent jurisdiction.

d. Exception to Arbitration: Either party may bring a lawsuit solely for injunctive relief to stop unauthorized use or abuse of the Site, or for intellectual property infringement, in any court of competent jurisdiction.

e. No Class Actions: You may only resolve disputes with us on an individual basis and may not bring a claim as a plaintiff or a class member in a class, consolidated, or representative action.

10. Termination

We may terminate or suspend your account and bar access to the Site immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms. If you wish to terminate your account, you may simply discontinue using the Site. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Miscellaneous Provisions

a.
